GENERAL TERMS AND CONDITIONS FOR USING THE WEBSITE

1. INTRODUCTION

Welcome to the website http://knigopis.unibit.bg, hereinafter referred to as "the Site", maintained by the University of Library Studies and Information Technologies (hereinafter referred to as "the University", "we", "us") . These Terms of Use (the "Terms", "Terms of Use", "Terms and Conditions") govern the use of http://knigopis.unibit.bg. The user using this site agrees to abide by these General Terms and Conditions, as well as by all provisions of the Bulgarian and international legislation. In case of disagreement with the Terms and Conditions, the user is obliged to immediately stop using the site. The University is not responsible if the user is not familiar with these conditions. These Terms apply to all visitors, users, and others who wish to access or use the Services on the Site.

Knigopis a portal that integrates the digital components developed under the project "Digitization of the repertoire of the Bulgarian National Renaissance Literature (1801-1878)", financed by the Research Fund under Contract No. DN 05/2 of 14.12.2016. The Site offers open access to bibliographic information about Bulgarian Renaissance printed books from the beginning of the XIX century to the Liberation of Bulgaria (1878). The database is accessed through information-searching, bibliometric and geographical information systems. The aim of the project is to provide fast, easy and comfortable way to use quantitative information for the study of a wide range of topics and issues related to the Bulgarian Renaissance. The new information product is a natural technological upgrade of the printed bibliographical catalogs, developed by several generations of foreign and Bulgarian scholars in the 19th and 20th centuries.

2. DEFINITIONS

In interpreting and applying these Terms, the terms and expressions used will have the following meaning:

2.1. USER is any individual who visits the site and uses its services.

2.3. A database is a collection of independent works, data or other materials arranged systematically or methodically and individually accessible electronically or otherwise.

2.4. Bibliographic information is the specific information that allows the identification of books in the database.

2.5. Converter is a digital tool for two-way conversion of dates with Cyrillic numeric values.

2.6. Paginator is a digital tool for multidirectional calculation and visualization of books in Cyrillic, Roman and Arabic pagination and collation.

2.7. GIS is an abbreviation of Geographic Information System, which is an information system for creating, manipulating, and storing, analyzing and visualizing geographically linked (spatial) data.

2.8. Information retrieval systems are a set of interconnected separate parts designed to search for any number of elements of information (documents, information, etc.) that respond to the information query addressed to the system. They are an e-bibliographic resource, presenting bibliographic information about Bulgarian Renaissance books (1801-1878).

2.9. Bibliometric systems are an e-bibliographic resource providing bibliometric information that can be managed through a set of filters.

2.10. "SERVICES" on the site include:

- access to information resources provided through a web browser/site data/database/ converter / paginator/GIS;

- study/research of topics and problems related to the Bulgarian Renaissance by user-defined criteria;

- the possibility of using and further working with bibliographic information in the database in MARC and ISBD formats, such as for the purpose of enriching and optimizing library catalogs, but not only. MARC (Machine-Readable Cataloging) is an international format that enables the standardization of the fields and structure of a bibliographic description by presenting the description itself through fields. It enables the exchange of bibliographic information and assists libraries in developing, using and managing their own databases. ISBD (International Standard Bibliographic Description) is a single standard that integrates the specifics of the bibliographic description of individual types of documents and replaces all other standards. It allows for the unhindered sharing of bibliographic information, overcoming the language barrier in its use, as well as the easier application of information technology in the exchange of such information.

2.11. An "electronic link" is a link marked on a particular web page in http://knigopis.unibit.bg portal, which allows automated referral to another websites, pages, information resources, or object through standardized protocols, including to a specific digital copy of a book.

2.12. Technical measures are any technology, device or component that, when used in their usual way, may interfere with or restrict unauthorized use of intellectual property rights (see 3 Intellectual Property Rights) in works, protected by the intellectual property legislation – national and international, if by such means the use of such work can be controlled by the right holder through an access code, blurring or other modification of the work or mechanism to control the copy.

2.13. "Malicious actions" are actions or lack of such that harm persons connected to the Internet or associated networks, including, but not limited to, sending spam, overflowing channels, accessing resources with foreign rights and passwords, exploiting deficiencies in systems for the purpose of harnessing or retrieving information, performing actions that may qualify as industrial espionage or sabotage, damaging or disrupting systems or information arrays, sending Trojans or causing installing viruses or remote control systems, interfering with the normal operation of other Internet users and associated networks, and committing any action that may qualify as a crime or administrative violation under Bulgarian law or other applicable law.

3. INTELLECTUAL PROPERTY RIGHTS

3.1. Website design, website structure, information search system, database, converter, paginator published on the site are subject to intellectual property rights (copyright, sui generis rights) and are protected under the copyright law in Bulgaria (Law on copyright and related rights), and their unregulated use constitutes an infringement and leads to civil, administrative and criminal liability in accordance with the Bulgarian legislation in force.

3.2. The holder of the intellectual property rights is the team, headed by Assoc. Prof. Vasil Zagorov PhD, composed of employees of the University, working on the project "Digitization of the repertoire of the Bulgarian National Renaissance Literature (1801-1878)", financed by the Research Fund under contract № DN 05/2 of 14.12.2016, composed of:

The team leader (Vasil Zagorov) has the right to represent the team as well as the University in the settlement of intellectual property rights with third parties.

3.3. The content of the Website is provided for free use for educational, scientific or personal purposes by any user, with mandatory citation of the parts used. Project DN 05/2 "Bibliography of the Bulgarian Revival Books (1801-1878)” funded by the National Scientific Fund.

3.4. For commercial purposes, the materials, tools or data of the site or parts thereof may be used under the terms of a license agreement signed by the Project Manager in accordance with item 3.2. and the site user. Any user of the site who wants to use the above-mentioned resources for commercial purposes should contact the contact person Vasil Zagorov by e-mail: v.zagorov@unibit.bg Commercial use of materials, tools or data from the site or parts thereof without the permission of the holder of the intellectual property rights is considered a violation of those rights and the user can be held liable under the applicable law.

3.5. The site uses data and objects from the e-catalogs of the national, academic, regional and community libraries in Bulgaria. The University has no claims for the intellectual property rights of these materials, they are intellectual property of its owners and access to them at http://knigopis.unibit.bg is provided under the conditions set by each of the rights holders.

4. CONFIDENTIALITY

The University is a personal data administrator registered under the Personal Data Protection Act. In connection with the use of the Services on the Site, we process personal information under the terms of our Privacy Policy. Policy is an integral part of the Terms and Conditions. These data are used for the following purposes:

• Communication with the users of the product for sending alerts for additions and corrections of the information in the database;

• Database performance reporting.

5. LIMITATION OF LIABILITY

The University accepts no responsibility for any damage and/or loss, resulting from the use or reading of the information and materials in or downloaded from its website. The University has made significant efforts to prepare the information and materials that are displayed on its website. We strive to ensure that the information on this site is correct. The site has electronic links / hypertext links to third-party websites outside the University and is provided for the convenience of users.

The University is unable to provide any guarantee as to the accuracy and completeness of the information contained within these third-party websites - this is a third-party obligation – for their websites published. In addition, by linking to other websites, the University does not in any way supports or endorses the views expressed or information stored on those sites and cannot give permission to use the information and materials found on those sites.

6. CONSUMER RIGHTS AND OBLIGATIONS

6.1. The user has the right to view, download, store, copy electronically and print physical copies of materials from this site (including pages, documents, files, photos) solely for his personal use, research or educational purposes.

6.2. The user has the right to change, reproduce (in whole or in part), publish, edit, send or transmit (in the form of mail, electronically or otherwise), create secondary materials based on the content of the site, distribute in any other way apart the ways cited here any element of the content of the site, use the content in another site or computer environment solely for its own personal use, research or educational purposes, and when citing the source in the following form:. 7. CHANGES AND UPDATES

The University has the right to update (add, modify, move and delete) the contents or parts thereof, to correct any errors, inaccuracies and omissions, at any time with and without notice. Users also have the right to propose changes to the site by using the contact form posted on it.

8. LAWS, JURISDICTIONS AND APPLICABLE LAW

The use of the site is subject to the laws of the Republic of Bulgaria. These General Terms and Conditions, as well as the provisions of Bulgarian law, will apply to the settlement of all issues and disputes. All disputes arising out of, related to or concerning these terms and conditions, which the parties have failed to resolve through negotiation and by mutual agreement, shall be referred to the competent Bulgarian authorities.
